The Henry County Board of Commissioners held a Regular Public Workshop Meeting at 9:00 a.m. on Tuesday, December 1, 2009, in the Community Room, County Administration Building, 140 Henry Parkway, McDonough, Georgia. Notice of this meeting was posted in the entrance foyer of the County Administration Building. The Daily Herald was notified of this meeting. Those present were:

††††††††††† Chairman Mathis called the meeting to order and called for an acceptance of the agenda.Commissioner Stamey made the motion to approve the agenda; Commissioner Jeffares seconded.The motion carried 5-0-0.

Recognition of awards given at the Georgia Recreation and Parks Association (GRPA) State Convention

††††††††††† The following awards were given and recognized by the Board:

1.       Tim Coley, Director of Parks and Recreation received the GRPA State Director of the Year Award for 2009

2.       Donna Holder, Executive Assistant received the GRPA Administrative Section Employee of the Year Award for 2009

3.       Kathy Hunt, Recreation Program Coordinator and Jason Morrison, Communications Designer received the GRPA Outstanding Publication Award for 2009

4.       Davina Ford, Recreation Specialist received the GRPA Marketing and Visibility Award for 2009

Authorization to accept a donation from Marie C. Santos of Cooper Seed

††††††††††† Jim Luebbering, Building and Development Services Division Director and Erik Lombard, Director of Stormwater presented the agenda item to the Board.The request is for authorization to accept sixty eight (68) bags of seed from Marie Santos of Cooper Seed to be used in detention facilities and easements.

††††††††††† Commissioner Holder made the motion to accept the donation; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, Marie C. Santos of Cooper Seed of Auburn, Georgia has sixty eight (68) bags of grass seed that they want to donate to Henry County Stormwater Management; and

††††††††††† WHEREAS, Henry County Stormwater Management can effectively use the grass seed for ongoing maintenance projects; and

††††††††††† WHEREAS, the donation would save Henry County Stormwater Management $2,107.00

††††††††††† NOW THEREFORE BE IT RESOLVED, the Board of Commissioners of Henry County authorizes the acceptance of the donation of sixty eight (68) bags of grass seed from Marie C. Santos of Cooper Seed of Auburn, Georgia valued at $2,107.00.

Award of an RFP to furnish design/build services for ten (10) new soccer fields and a concession stand at North Mt. Carmel Park

††††††††††† Tim Coley, Director of Parks and Recreation presented the agenda item to the Board.An RFP for design/build was issued and thirteen (13) proposals were received and reviewed.After review it was narrowed down to six (6) vendors and those vendors were interviewed and the list was narrowed down to three (3) and staff decided what was the best price and design.With the growing number of participants that are playing soccer and the tournaments that generate revenue, staff felt the need to build additional fields.They will replace the fields in front of the Administration Building.Funding is available and the project was approved in the SPLOST III program.

††††††††††† Commissioner Stamey stated this will give the Soccer Association a total of fourteen (14) fields.Mr. Coley stated that was correct.Commissioner Stamey asked if that will certify that soccer tournaments can be held in Henry County.Mr. Coley stated that was correct.

††††††††††† Commissioner Holder asked how many parking spaces were available in this park.Mr. Coley stated originally there were 230 spaces and with this addition there will be 400 additional spaces with 400 grass parking spaces that will be utilized during tournaments.There will be approximately 1,100 total parking spaces.

††††††††††† Commissioner Jeffares made the motion to approve the resolution; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, proposals were solicited to furnish design/build services for ten (10) new soccer fields and one (1) new concession stand at North Mt. Carmel Park in Hampton, Georgia; and

††††††††††† WHEREAS, thirteen (13) proposals were received and reviewed; and

††††††††††† WHEREAS, the review committee shortlisted the following five (5) firms; Hogan, Panattoni, Beck, Pond and Potts Construction; and

††††††††††† WHEREAS, funding for this is available in the SPLOST III North Mt. Carmel Park project account; and

††††††††††† WHEREAS, staff recommends the low bidder, Potts Construction in the amount of $1,897,685.00;

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Henry County Board of Commissioners approves the RFP/Bid of Potts Construction and awards RFP number SP-10-15-102209-9 to furnish Design/Build services for ten (10) new soccer fields and one (1) new concession stand at North Mt. Carmel Park in Hampton, Georgia in the amount of $1,897,685.00.The Chairman is hereby authorized to sign all necessary documents for this project.All budget amendments and/or transfers necessary for proper accounting of this resolution will hereby be approved.

Award of a bid for the construction of SR81 at Keys Ferry Road intersection improvement

††††††††††† Roque Romero, SPLOST Transportation Project Director presented the agenda item to the Board.State Route 81 at Keys Ferry Road is a designated SPLOST III Transportation project.This is the last step out of a three step process.A letter was received from the Georgia Department of Transportation (GDOT) to proceed with the recommended low bidder, Pittman Construction Company in the amount of $536,929.19.Funding for this project is available from the project account with reimbursements from the American Recovery and Reinvestment Act (ARRA).

††††††††††† Commissioner Holder asked what the total cost for this project is; $536,929.19 is the construction cost.Mr. Romero stated the design and right of way was done in the SPLOST II programs.The grand total with the design, right of way and construction is approximately $700,000.00.

††††††††††† Commissioner Holder made the motion to award the bid to Pittman Construction Company in the amount of $536,929.19; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, SR81 at Keys Ferry Road is a SPLOST III Transportation project; and

††††††††††† WHEREAS, sealed bids were solicited for the construction; and

††††††††††† WHEREAS, nine (9) sealed bids were received and reviewed; and

††††††††††† WHEREAS, funding for this project is available in the project account with reimbursements from the American Recovery and Reinvestment Act (ARRA) in the amount of $536,929.19; and

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Henry County Board of Commissioners awards Bid Number SB-10-10-093009-1 to Pittman Construction Company for construction of the intersection improvement of SR81 @ Keys Ferry Road in the amount of $536,929.19.The Chairman is hereby authorized to sign all necessary documents for this project.All budget amendments and/or transfers necessary for proper accounting of this resolution will hereby be approved.

Approval of a contract with the Georgia Department of Transportation regarding a reimbursement for resurfacing 7.258 mile of various county roads

††††††††††† Terry McMickle, Public Works Division Director presented the agenda item to the Board.This is a LARP contract that provides for resurfacing 7.258 miles of county roads.Georgia Department of Transportation (GDOT) will reimburse the county for a portion of the cost.

††††††††††† Commissioner Holder made the motion to approve the contract and authorize the Chairman to sign; Commissioner Basler seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, Henry County DOT has inspected the roadway system and developed a resurfacing program and requested GDOT funding; and

††††††††††† WHEREAS, Georgia Department of Transportation would like to assist Henry County in the resurfacing of various county roads; and

††††††††††† WHEREAS, GDOT will provide funding on recycled asphalt, bituminous tack coat, and striping as a unit price contract, but not to exceed a total of $276,758.73.

††††††††††† NOW, THEREFORE, BE IT RESOLOVED, the Board of Commissioners of Henry County authorizes the Chairman to sign contract #S012031-LAR.

Approval of a contract with the Georgia Department of Transportation regarding a reimbursement for resurfacing 3.540 miles of various county roads

††††††††††† Terry McMickle, Public Works Division Director presented the agenda item to the Board.This is a LARP contract that provides for resurfacing 3.540 miles of county roads.Georgia Department of Transportation (GDOT) will reimburse the county for a portion of the cost.The reason there are two contracts is because Henry County is located within two GDOT districts.

††††††††††† Commissioner Basler made the motion approve the contract and authorize the Chairman to sign; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

WHEREAS, Henry County DOT has inspected the roadway system and developed a resurfacing program and requested GDOT funding; and

List of Roadways for use of Speed Detection Devices

††††††††††† Terry McMickle, Public Works Division Director presented the agenda item to the Board.With changes in road conditions and the growth in the county, speed limits have to be adjusted.The various roadways have to be certified for the Police Department to run radar.The Police Department has also reviewed the list.The Georgia Department of Safety will issue a permit that will allow law enforcement personnel to use detection devices on the named roadways.

††††††††††† After discussions regarding various roads and speed limits Chairman Mathis stated there are several roads that need to be reviewed and this list could not be adopted.Mr. McMickle stated the list that the Chairman signs will be the list that is approved by the Board.Chairman Mathis stated it would be a good idea to table this item so that it can be reviewed and corrections made before the final draft is approved.Mr. McMickle stated if a change is made the list will need to be submitted to the GDOT Thomaston Office for approval of the changes.

††††††††††† Commissioner Holder asked how long the process will take.Mr. McMickle stated they have been working on this list for at least seven (7) months.Itís possible that the list will not be ready for the next meeting.Chairman Mathis asked if the list is not approved at this meeting, will the certification expire on existing roadways.Mr. McMickle stated no there is an existing certified list that will continue to be used.

††††††††††† Commissioner Bowman made the motion to table this item; Commissioner Basler seconded.The motion carried 5-0-0.

List of Roadways for use of Speed Detection Devices

Mr. McMickle came back to the Board to state the Speed Limit List expires 12/31/2009.Commissioner Bowman made the motion to rescind his previous motion to table the list of roadways for use of speed detection devices; Commissioner Basler rescinded his second.The motion carried 5-0-0.

Commissioner Bowman made the motion to approve the list of roadways for use of Speed Detection Devices; Commissioner Basler seconded.The motion carried 5-0-0 approving the following resolution:

WHEREAS, Georgia Department of Transportation has certified a list of various roadways in Henry County with assigned speed limit for each of the roadway on the list; and

WHEREAS, Henry County Department of Transportation staff has reviewed this list and each district commissioner have had the opportunity to examine the same list; and

WHEREAS, an acceptance by the Henry County Board of Commissioners is necessary so that detection devices can be used by law enforcement personnel on potential violators

NOW, THEREFORE, BE IT RESOLVED, that the Henry County Board of Commissioners approve the final draft of the Georgia Department of Transportationís Certified Speed Limit List.

Authorization to reallocate funding for Cleveland Church Road resurfacing project

††††††††††† Terry McMickle, Public Works Division Director presented the agenda item to the Board.The Department of Transportation (DOT) has been working on this project for approximately a year ago.This is a dirt road that is being paved. The design has been completed and there have been meetings with the residents along the road.The request is to transfer funds from the Mitchell Road project to the North Cleveland Road Paving Project.The project cost including right of way, material cost and engineering is $81,333.00.

††††††††††† Commissioner Jeffares made the motion to approve the request; Commissioner Bowman seconded.The motion carried 4-0-0 approving the following resolution (Commissioner Holder was not present for the vote):

††††††††††† WHEREAS, the surveying and engineering has been completed to do the project; and

††††††††††† WHEREAS, all but a couple of parcels donated right of way with an understanding that the road would be improved; and

††††††††††† WHEREAS, the project can be funded by reallocation of approximately $81,333.00 in District II funds, and therefore allow Henry County to immediately proceed with construction of the project.

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Board of Commissioners of Henry County approves reallocating $81,333.00 of the $112,481 from DT0307 Mitchell Road/Jonesboro Road to McCullough Road to the North Cleveland Church Road resurfacing project DT8008.The Chairman is hereby authorized to execute all appropriate documentation to accomplish this transfer.All budget amendments and transfers necessary to complete this transaction are hereby approved.

Acceptance of the Edward Byrne Memorial Justice Assistance Grant

††††††††††† Major Danny Butler, Police Department presented the agenda item to the Board.The request is for authorization to accept the Edward Byrne Memorial Justice Assistance Grant in the amount of $23,399.00 to purchase an automated license plate recognition system.

††††††††††† Commissioner Bowman made the motion to accept the grant; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

WHEREAS,†† The Henry County Police Department seeks to enhance the agencyís ability to recover stolen vehicles; enforce existing violations of suspects via vehicle registrations; track known perpetrators as they transport illegal substances or use the vehicles in the commissions of other crimes; and trace and identify vehicles involved in Amber Alerts; and

 

WHEREAS,†† In order to perform these and other functions, the agency has located funding to purchase an ALPRS under a local allocation of the Edward Byrne Memorial Justice Assistance Grant; and

 

WHEREAS,†† The ALPRS uses image-processing technology; officers can impose a mass surveillance in parking lots, along the roadside, or in traffic up to 100 mph to identify vehicle tags via optical character recognition; and

 

WHEREAS,†† The Edward Byrne Memorial Justice Assistance Grant awarded the police department with $23,399.00 to purchase an ALPRS. No matching funds are required with this grant;

 

NOW, THEREFORE, BE IT RESOLVED, by the HENRY COUNTY BOARD OF COMMISSIONERS hereby approves the acceptance of $23,399.00 from the Edward Byrne Memorial Justice Assistance Grant for the purchase of an ALPRS.

Acceptance of the Governorís Office of Highway Safety (GOHS) Grant

††††††††††† Major Danny Butler, Police Department presented the agenda item to the Board.Over the last five years the Governorís Office of Highway Safety has awarded the Henry County Police Department over almost $500,000.The request is for authorization to accept the grant in the amount of $58,400.00 for the H. E. A. T. program.

††††††††††† Commissioner Holder made the motion to authorize acceptance of the grant; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

WHEREAS, the purpose of the H.E.A.T. program is to enforce D.U.I., speeding, and aggressive driving laws and to educate the importance of occupant safety to the citizens and visitors of Henry County; and

 

WHEREAS, the 2009-2010 GOHS grant will fund 40% and the county will fund 60% of the allowed cost of the HEAT unit. The allowed cost is for salaries and benefits off two (2) officers, one (1) GOHS training conference and NexTel service for four (4) officers. The total amount of these cost is $145,995.00; and

 

WHEREAS, the GOHS will contribute $58,400.00 and the county will allocate $87,600.00 from the police department budget to fund the unit. Other operating costs of the unit (i.e. cars, duty gear, training, etc.) have been and will continue to be absorbed by the county; and

 

NOW, THEREFORE, BE IT RESOLVED, by the HENRY COUNTY BOARD OF COMMISSIONERS hereby approves the acceptance the $58,400.00 grant from GOHS for the subsidizing of the H.E.A.T. program and will complete all necessary documentation provided by the grant.

Bid to purchase and install in-car video systems for Police Patrol Vehicles

††††††††††† Major Danny Butler, Police Department presented the agenda item to the Board. Seven new vehicles have been ordered and received for the Police Department.In-car video equipment is required to equip each vehicle for service.The bid documents were given to eight vendors and three vendorsí submitted bids.The request is to award the bid to Integrated Technology Systems in the amount of $31,219.80.

††††††††††† WHEREAS, sealed bids (SB-10-19-110409-3) were solicited for the purchase and installation of in-car video systems for the Police Department; and

††††††††††† WHEREAS, three (3) vendors submitted bids for this purchase, as indicated on the attached bid tab; and

††††††††††† WHEREAS, funds are available in the Police Departmentís account to complete this purchase; and

††††††††††† WHEREAS, Integrated Technology Systems has submitted the lowest and most responsive bid for the purchase and installation of the in-car video system; departmental personnel recommended award to Integrated Technology Systems.

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Board of Commissioners of Henry County awards Bid Number SB-10-19-110409-3 to Integrated Technology Systems in the total amount of $31,219.80 for the purchase and installation of seven (7) in-car video systems on Police vehicles.The Chairman is hereby authorized to execute all appropriate documentation to accomplish this purchase.

Authorization to accept a technology grant from the US Department of Justice

††††††††††† Susan Clegg, Assistant Director for Emergency Communications presented the agenda item to the Board.These funds were requested and supported by Congressman David Scott and will be used to purchase technology and communications equipment for the Emergency Operations Center.The grant is administered through the US Department of Justice and the grant total is $175,000.00.There is no match required.

††††††††††† Commissioner Basler made the motion to approve the request; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, development of the emergency operations center is critical for support of response and recovery from any disasters that may affect Henry County; and

††††††††††† WHEREAS, the emergency management agency is charged to coordinate overall response, recovery, and mitigation to events; and

††††††††††† WHEREAS, the U. S. Department of Justice has provided $175,000.00 in funds to implement technologies in the emergency operations center, and emergency communications center;

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Henry County Board of Commissioners authorizes the Chairman of the Board of Commissioners to accept the grant in the amount of $175,000 and to execute any documents necessary to purchase needed equipment.

Approval of a Performance Partnership Agreement with the Georgia Emergency Management Agency

††††††††††† Susan Clegg, Assistant Director for Emergency Communications presented the agenda item to the Board.Under the Performance Partnership Agreement, once completed, the County will annually receive funding to support the operations of the Emergency Management Agency.The funds are award to the local emergency management agencies for completing a program of work and maintaining the Certified Emergency Manager status.Don Ash, EMA Director currently holds that certification.The total amount Henry County is due to receive is $35,802.30.

††††††††††† WHEREAS, the Henry County Emergency Management Agency serves all the communities of Henry County; and

††††††††††† WHEREAS, the Emergency Management Agency will have direct responsibility for the organization, administration, and operations of the local organization for emergency management; and

††††††††††† WHEREAS, the Performance Partnership Agreement, with Georgia Emergency Management Agency, provides funding in the amount of $35,802.30 for fiscal year 2009 to the Henry County Management Agency

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Henry County Board of Commissioners authorizes the Chairman of the Board to execute the Performance Partnership Agreement with Georgia Emergency Management Agency on behalf of the Henry County Board of Commissioners.

Authorization to accept funds from the Governorís Office

††††††††††† Susan Clegg, Assistant Director for Emergency Communications presented the agenda item to the Board.Each year the local Emergency Management Agencies can submit grant applications for the purpose of maintaining and supporting the United Citizen Force such as the CERT (Citizenís Emergency Response Teams) Program.To date Henry County has 202 members of the CERT Program.The Governorís Office has awarded grant funds in the amount $14,000.00.

††††††††††† Commissioner Holder made the motion to approve acceptance of the grant funds; Commissioner Stamey seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, development of the Citizens Emergency Response Team, provides a standard of training in assisting our citizens and protecting lives; and

††††††††††† WHEREAS, the CERT Program is a vital part of emergency preparedness for the citizens of Henry County; and

††††††††††† WHEREAS, the CERT Program will be offered throughout our community to assist in developing the Knowledge of our citizens; and

††††††††††† WHEREAS, the State of Georgia Governorís Office has provided $14,000.00 in funds to continue in the training of our citizens through the CERT program

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Henry County Board of Commissioners authorizes the Chairman of the Board of Commissioners to accept this funding and execute any documents necessary to purchase needed CERT equipment.

 

Bid award for Solid Waste Removal

††††††††††† Mike Bush, Finance Director presented the agenda item to the Board.This bid is for the dumpster service at each county building.The current contract will expire on December 31, 2009.Bids were requested by nine (9) vendors and two (2) vendors responded.The request is to award the bid to the lowest bidder Waste Management.This is a two year contract with a small increase.

††††††††††† Chairman Mathis asked did any of the local vendors submit a bid.Mr. Bush stated the bid was posted on the Henry County Website, The AGLGA Marketplace listing and nine (9) vendors and he was not aware if any of them were local vendors.

Commissioner Holder made the motion to award the bid to Waste Management; Commissioner Jeffares seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, the Invitation to Bid was posted on the Henry County Website, listed on the GLGA Marketplace and nine (9) sealed bids (SB-10-16-101409-3) were solicited for Solid Waste Removal / Disposal Services for County locations; and

††††††††††† WHEREAS, two (2) vendors submitted bids for dumpster services, as indicated on the attached bid tab; and

††††††††††† WHEREAS, funds are available in the department accounts for these services; and

††††††††††† WHEREAS, Waste Management has submitted the over all lowest and most responsive bid

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Board of Commissioners of Henry County awards Sealed Bid Number SB-10-16-101409-3 to Waste Management, the overall lowest and most responsive bid for the Solid Waste Removal / Disposal Services; award as a unit price contract with no fixed quantities; prices will remain firm for the contract period.The Chairman is hereby authorized to execute all appropriate documentation to accomplish this purchase of solid waste dumpster services.

Bid to repair the roof of Fire Station No. 1

††††††††††† Mike Bush, Finance Director presented the agenda item to the Board.A Request For Proposal (RFP) was sent to area and local vendors as well as posted on the Henry County Website and the ACCG/GLGA website.Three (3) vendors responded to the bid and staff recommended the bid be awarded to Werner General Contracting.

††††††††††† Commissioner Bowman made the motion to award the bid to Werner General Contracting; Commissioner Basler seconded.The motion carried 5-0-0 approving the following resolution:

††††††††††† WHEREAS, sealed proposals (SP10-14-100709-1) were solicited for a project to repair the roof of Fire Station No. 1 for the Fire Department; and

††††††††††† WHEREAS, three (3) vendors submitted bids for this project, as indicated on the attached bid tab; and

††††††††††† WHEREAS, funds are to available complete this project; and

††††††††††† WHEREAS, Werner General Contracting has submitted the lowest and most responsive bid for the roof repair project; departmental personnel recommend awarde to Werner General Contracting

††††††††††† NOW, THEREFORE, BE IT RESOLVED, the Board of Commissioners of Henry County awards Bid Number SP-10-14-100709-1 to Werner General Contracting in the total amount of $29,146.00 for roof repairs at Fire Station No. 1; the project will include all work listed as ďOption No. 3Ē and shall be completed in accordance with the bid specifications.The Chairman is hereby authorized to execute all appropriate documentation to accomplish this purchase.

††††††††††† Chuck Ekstedt, 508 Guinevere Court spoke regarding a rezoning of approximately 180 acres located within Commission District 1.

1.      Thursday, December 10th at 5:30 p.m. a Local Delegation Meeting to be held at the Administration Building in the Community Room, 140 Henry Parkway, McDonough.

2.      Monday, December 14th at 9:00 a.m. and Tuesday, December 15th at 6:30 p.m. are Regular Board Meetings

3.      Thursday, December 24th and Friday, December 25th all County Offices will be closed in observance of the Christmas Holidays

4.      Monday, January 4th at 9:00 a.m. a Workshop Meeting and Tuesday, January 5th at 9:00 a.m. a Regular Board Meeting

Executive Session

Commissioner Basler made the motion to adjourn into Executive Session in accordance with the provisions of O.C.G.A. 50-14-3, and other applicable laws, and pursuant to advice by LaTonya Wiley, the County Attorney, for the purposes of discussing the acquisition of real estate, pending and/or potential litigation, and personnel matters; Commissioner Stamey seconded.The motion carried 5-0-0.

Commissioner Stamey made the motion to reconvene into Public Session; Commissioner Jeffares seconded.The motion carried 5-0-0.

Commissioner Jeffares made the motion to approve the affidavit and resolution pertaining to Executive Session; Commissioner Holder seconded.The motion carried 5-0-0.

Commissioner Jeffares made the motion to amend the agenda out of public necessity and to approve a resolution authorizing the acquisition of 0.2754 acres of right of way, more or less; 0.108 acres of temporary easement, more or less; 0.013 acres of driveway easement, more or less in Land Lot 225 of the 7th District, Henry County, Georgia by negotiated contract or condemnation pursuant to provisions of O.C.G.A. Sections 32-3-4 thru Section 32-3-19; Commissioner Holder seconded.The motion carried 5-0-0.

Chairman Mathis announced a called meeting for December 2nd at 4:00 pm to announce the new County Manager.
